ON SEPTEMBER 20, 2001, THE REGION FORWARDED AN EXPEDITED DIRECT REFERRAL TO THE DEPARTMENT OF JUSTICE ( DOJ ) IN CONNECTION WITH THE PAOLI RAIL YARD SUPERFUND SITE ( SITE ) LOCATED IN PAOLI, CHESTER COUNTY. PENNSYLVANIA. THE REFERRAL REQUESTS DOJ TO SEEK A WARRANT PURSUANT TO SECTION 104(E) OF THE COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION, AND LIABILITY ACT OF 1980. THE WARRANT IS NEEDED TO ALLOW EPA TO ENTER, SAMPLE AND EXCAVATE CONTAMINATED STREAM SEDIMENTS FROM THE SOURCE POINT OF THE HOLLOW ROAD TRIBUTARY. PREVIOUS SAMPLING OF THE STREAM SEDIMENTS DEMONSTRATED THE PRESENCE OF PCB CONTAMINATION AT NEARLY TWO HUNDRED TIMES THE CLEAN UP STANDARD OF 1 PPM.
