EPA v. NATIONAL GYPSUM, IN RE
Case summary
The original Proof of Claim that I sent you was filed in 1991. The case was settled and closed. In 1998, after I came to EPA, it was decided that we needed to reopen the settlement. Since the matter was closed. DOJ told us to submit a referral. We referred the matter, and had a conference with the Judge. The Debtor consented to reopening the matter, Region with judge and other parties agreeing on the phone to reopen the matter consensually. Court decided to keep the original docket number (when reopening a matter whether to keep the old docket number or give a new one is a matter of discretion for the court). Order approving Amendment to second settlement agreement among debtors and the United States of America.
