Case summary

On August 21, 1991, EPA issued a Record of Decision for the NCR Site which entailed, among other things, extraction/treatment of contaminated groundwater; discharge to surface water and/or an on-Site surface water infiltration gallery; performance of a well survey; and quarterly monitoring of groundwater. On March 31, 1992, EPA issued Administrative Order No. 111-92-14-DC ( March 1992 Order ) to NCR Corporation and First Omni Bank, National Association ( Respondents ), directing these parties to implement the ROD. EPA issued modifications to the March 1992 Order on March 25, 1993; August 5, 1994; April 11, 1996, and October 26, 1998. On September 27, 2016, EPA issued an Explanation o{Significant Differences which selected several in-situ groundwater remedial technologies to enhance the groundwater pump and treat system originally called for in the ROD. This document further. modifies the March 1992 Order to direct the Respondents to implement the ROD, as modified by the 2016 Explanation o{Significant Differences.
