EPA v. OCEANA NAVAL AIR STATION

Case summary

On April 1, 2022, the Director of the Land, Chemicals, and Redevelopment Division, Region III, signed an amendment to a RCRA administrative order on consent ( Order ) issued by EPA in 1991 directing the U.S. Navy to undertake corrective measures studies at the Naval Air Station Oceana, in Virginia Beach, VA. EPA has overseen the work since issuance of the 1991 order. While more work is necessary at the station, EPA and the Navy have decided that to better align the Navy's environmental restoration actions with its cleanup authorities, streamline regulatory oversight of the environmental restoration actions, and facilitate completion of the environmental restoration work, oversight of the work should be transferred to the Commonwealth. To that end, the amendment provides that any response action selected, implemented, and completed to remediate releases of hazardous substances, pollutants or contaminants, hazardous waste, or hazardous constituents at or from the Facility, under either RCRA or CERCLA, will substantively satisfy the requirements of both programs. Further, the amendment terminates the Order upon the effective date of a Federal Facility State Remediation Agreement ( FFSRA ) between the Navy and the Virginia Department of Environmental Quality. The public was invited to comment on the FFSRA and the Order amendment for 30 days, after which no public comments were received by EPA or the Navy. An EJ Screen of the facility indicates that Naval Air Station Oceana is not located in an area of EJ concern.
