Case summary
This Administrative Order on Consent (AOC) is being issued to Respondent for violations of the New York State Department of Environmental Conservation SPDES General Permit for Stormwater Discharges from Municipal Separate Storm Sewer Systems (MS4s). Violations include failure to develop, implement, and enforce a Stormwater Management Program (SWMP) Plan; failure to provide opportunities for the public to participate in the development, review and implementation of the SWMP Plan; failure to develop, implement and enforce an illicit discharge detection elimination program; and, failure to develop, implement and enforce a program to ensure proper operation and maintenance of post-construction stormwater management practices. The AOC includes a compliance schedule requiring Respondent to address deficiencies identified during EPA's May 30, 2024 and June 5, 2024 compliance evaluation audit.
