EPA v. Hauler's Facility LLC et al. - LCDM Onondaga

Case summary

On January 22, 2026, the U.S. District Court for the Northern District of New York entered a consent decree between EPA, 14 peripheral potentially responsible parties (PRPs), and the environmental response trust created by the General Motors bankruptcy (the RACER Trust) regarding the Onondaga Lake Superfund Site located in and around Syracuse, New York. Under the consent decree, the CERCLA liability of the 14 peripheral PRPs is being resolved for the Ley Creek Deferred Media operable unit (LCDM OU) of the site, where there was historic PCB disposal. The settlement also resolves the settling parties? liability related to a contribution action filed against them by the RACER Trust, as well as related counterclaims filed in that action. The consent decree requires payment of $1,809,916 to EPA in reimbursement of past and future response costs incurred at the LCDM OU, as well as an additional $200,000 to the RACER Trust. The consent decree was lodged on November 4, 2025, and the United States did not receive any public comments. This is the second settlement agreement entered in this case; the first was entered on August 27, 2025, and required 15 distinct PRPs to pay $12.7 million to EPA for past and future response costs incurred at the LCDM OU.
