Case summary

Respondent owns and operates a 20.8-acre property in the Municipality of Salinas, Puerto Rico. On or about December 2020, the Respondent conducted earthmoving activities which extended beyond the property boundary lines. EPA determined that the Respondent conducted the earthmoving work, including land clearing, excavation, and filling activities, with mechanized equipment, within approximately 6.8 acres of forested wetlands and open waters of the Caribbean Sea. Respondent is ordered to cause no discharges of dredged or fill material into waters of the United States, which includes jurisdictional wetlands, except as authorized by a valid permit issued by the U.S. Army Corps of Engineers pursuant to Section 404 of the Clean Water Act, 33 U.S.C. ? 1344, or as exempt from Section 404 permitting authority.
