Case summary

Respondent is a petroleum product storage facility and a joint occupant with Port Hamilton Refining & Transportation (PHRT) of the Facility. Industrial operations occupy approximately 75 acres of the land area of the Facility based in St. Croix, USVI. The Facility was inspected by EPA on 5/3-7/2021 and revealed that the facility discharges storm water associated with an industrial activity and has failed to secure the appropriate NPDES permit to operate while discharging pollutants in a water of the US. EPA has taken enforcement action against the Operator by issuing ACO, CWA-02-2023-3113 on July 21, 2023, requiring the Respondent to come into full compliance with applicable regulations of the CWA.
