Case summary
Despite implementing various control measures in accordance with EPA Order CWA-02-2017-3050, stormwater sampling at the Respondent's Brockway Place Transfer Station (White Plains, NY) continues to be consistently above the benchmark cut-off concentrations specified in NYSDEC?s SPDES MSGP. Respondent has failed to take necessary corrective actions following benchmark exceedances as required by the MSGP. The Order sets forth an implementation schedule for a proposed Best Management Practice (BMP) and requires the Respondent to take additional corrective actions should it experience further exceedances following installation of the BMP. The Order also requires the Respondent to submit quarterly progress reports to EPA and NYSDEC.
