Case summary
The Barth Smelting Corporation Site is located in a mixed residential and industrial neighborhood within the Ironbound Section of Newark, Essex County, New Jersey. EPA conducted three removal actions at the Site, for which it incurred costs, in order to remediate lead contamination on-site. EPA sought recovery for unreimbursed past response costs incurred by EPA at the Site, against one potentially responsible party, the corporate successor to a former Site owner/operator, The New Jersey Zinc Company, Inc. As a result of negotiations, the potentially response party and EPA came to an agreement, which is embodied in the fully executed consent decree.
