EPA v. McFar Contractors Inc.
Final Order With Penalty
Case summary
On or about December 22, 2017, EPA received a referral from the New York City Department of Health and Mental Hygiene (NYCDOHMH) based on an inspection that NYCDOHMH had conducted that day at a residential property located at 75 Bank Street in New York, NY. Based on the information obtained from the referral and a subsequent IRL response, EPA determined that the company may have violated the RRP Rule by failing to obtain lead-safe firm certification, failing to provide the owner of the unit(s) with the EPA-approved lead hazard pamphlet (Renovate Right), failing to contain the work area so that no dust or debris leaves the work area while the renovation is being performed, and failing to clean the work area until no dust, debris, or residue remains after the renovation has been completed. EPA is seeking a penalty and the company's return to and maintenance of compliance.
