Case summary
On September 16, 2021, Region 2 entered into an Administrative Order and Settlement Agreement under CERCLA with five Respondents, all redevelopment entities, for the upgrade of an aging bulkhead at the Gowanus Canal Superfund Site in Brooklyn, New York. This is one in a series of new bulkheads needed to provide structural support for the dredging and capping of the Canal, which began in November 2020 and is ongoing. The work under the AOC is valued at $5,000,000. EPA also facilitated two related key side agreements. The first provided funding to Respondents from the parties performing the dredging, in lieu of their constructing the bulkhead under a separate EPA order. The second provided for both respondents and performing parties to make temporary business relocation payments to an impacted tenant movie studio.
