Case summary

Respondent imported 40 outboard motors and outboard motor engines on or about July 7, 2020. Authorized federal inspectors examined the Subject Engines and did not observe any Emission Control Information (ECI) labels on the Subject Engines. In a provided Certificate of Conformity and on EPA Form 3520-21, Respondent claims the engine family to be JZHYM.139P04. Upon verifying with EPA?s databases, the Certificate of Conformity for engine family JZHYM.139P04 is for a 2018 model year engine and is not valid for the Subject Engines. The EPA has found no further evidence indicating the Subject Engines are certified, exempt or otherwise excluded from coverage under Title II the Clean Air Act (CAA) and its implementing regulations. Accordingly, by importing the Subject Engines, Respondent has committed 40 violation of CAA Sections 203(a)(1) and 213(d), 42 U.S.C. 7522(a)(1) and 7547(d), and the regulations codified at 40 C.F.R. 1068.101(a)(1) and (b)(5).
