Case summary

The Consent Judgment resolves Defendants' noncompliance with EPA's Class V Underground Injection Control regulations (Class V Rule) that banned new and existing large-capacity cesspools (LCCs) as of April 5, 2005, and motor vehicle waste disposal wells (MVWDWs) as of January 1, 2008. The CD establishes a schedule to eliminate all prohibited LLCs and MVWDWs and eliminate or replace them with an innovative alternative on-site wastewater treatment system and/or holding tanks by no later than December 2030. The CD also requires Defendants to pay a $200,000 civil penalty.
