Case summary

The consent decree provides for the Defendant to undertake the remedy selected in EPA's September 25, 2018, Operable Unit 8 (OU8) Record of Decision (ROD) for the American Cyanamid Superfund Site in Bridgewater Township, Somerset County, New Jersey, and to reimburse all of EPA's future oversight costs for OU8. The remedial action is expected to cost $69 million. The Defendant is performing the remedial design for the OU8 remedy, estimated to cost $5 million, pursuant to a 2019 Administrative Settlement Agreement and Order on Consent issued by EPA. EPA does not have outstanding past response costs, as the Defendant has paid EPA's Site-related costs under previous settlements. The proposed CD therefore does not require the Defendant to pay past response costs. OU8 is expected to be the last operable unit at the Site.
