Case summary

As a result of an inspection, conducted on August 27, 2019, EPA determined the Respondent was not in compliance with the NYSDEC MSGP. Potential violations identified included: Failure to develop and maintain an adequate SWPPP, failure to conduct and record required monitoring and inspections including annual dry weather flow monitoring, quarterly BMP inspections and semi-annual benchmark monitoring. Respondent was also not properly maintaining and implementing BMPs including failure to remove sediment from the stormwater practice preceding Outfall 1. An Information Request and Administrative Compliance Order is being issued to the Respondent.
