Case summary

Respondent is a permitted Phase II MS4 in New Jersey. An MS4 Audit was conducted on May 8-9, 2018. As a result of the inspection, it was determined that the Respondent was not complying with the terms and conditions of the NJDEP Highway Agency General Stormwater Permit. An Information Request and Administrative Compliance Order (ACO), CWA-02-2018-3053, was issued to Respondent on September 18, 2018 requiring Respondent to correct the violations. The ACO also established a compliance schedule to bring Respondent into compliance with the NJDEP Highway Agency General Permit. Since issuance of the ACO, Respondent has not complied with CWA-02-2018-3053. Therefore, the EPA is issuing a complaint with a penalty to Respondent for past violations and to bring Respondent into compliance with the terms and conditions of the NJDEP Highway Agency Permit.
