Case summary
Respondent owns and operates the facility located at or near 75 Crows Mill Road in Keasbey, New Jersey. Stormwater from the facility drain to the Raritin River and several small creeks. Respondent has coverage for its stormwater discharges under an individual NJPDES Permit. EPA conducted a Compliance Evaluation Inspection (CEI) at the Facility on June 19, 2019 and identified noncompliance items, including, but not limited to the following: Failure to implement the Stormwater Pollution Prevention Plan (SPPP); failure to fully develop and implement Best Management Practices (BMPs) including failure to cover full containers, failure to conduct inspections, and failure to implement provisions of the Permit. The Administrative Order requires Respondent to comply with the terms and conditions of its NJPDES permit. The Order is being issued with an Information Request, which requires, among other things, Respondent to revise the SPPP, and to submit a plan of action for addressing non-compliance items.
