Respondent operates a precast concrete facility. On May 10, 2019, EPA conducted an inspection and identified that the Facility conducts industrial activity regulated under 40 C.F.R. 122.26 and discharges stormwater associated with industrial activity, including runoff from concrete mix loading area, to a tributary to the Hudson River via an on-site storm sewer system and outfall. At the time of the inspection, the Facility did not have coverage under a SPDES Permit.
