On December 3, 2018, EPA conducted an inspection and identified that the Respondent conducts industrial activity regulated under 40 C.F.R. 122.26 and discharges stormwater associated with industrial activity to Newark Bay via the City of Newark's Municipal Separate Storm Sewer System (MS4). At the time of the inspection, the Facility did not have coverage under a NJPDES Permit.
