Respondent was subject to inspection under the Renovation, Repair, and Painting Rule, and was inspected for recordkeeping on July 12, 2017. During the inspection and subsequent recordkeeping review, it was revealed that Respondent performed window replacements at multiple locations in North Western New York State. A number of these locations met the description of Target Housing as outlined in the Code of Federal Regulations. In completing these jobs, EPA determined the Respondent failed to obtain initial firm certification, failed to establish proper records to demonstrate compliance with the RRP rule, failed to assign a certified renovator to each applicable job, and failed to obtain acknowledgement from the owner of each housing unit that he/she received the Renovate Right pamphlet. The Respondent has been required to pay $95,000 and prepare and adhere to a compliance plan for all future applicable renovations.
