Case summary

The order requires the Respondent to undertake corrective action work at a permitted hazardous waste treatment and storage facility the company owns and operates in Elizabeth, New Jersey. At this facility, the company recovers spent solvents and treats both hazardous and non-hazardous (solid) wastes. EPA investigations of the site have uncovered numerous areas of soil and groundwater contamination. Based upon an EPA determination that the Respondent's past and present handling, storage, treatment or disposal of hazardous waste at the facility may present an imminent and substantial endangerment to human health and/or the environment, the AOC orders the company to do a clean-up of the site. More specifically the company will undertake: (1) a RCRA Facility Investigation to characterize and delineate the contaminant conditions at the site; (2) a Corrective Measures Study to evaluate remedy alternatives and recommend appropriate remedial measures; and (3) implementation of appropriate remedial measures. The selected corrective measures may include requirements for post-remedial care and interim corrective measures.
