Case summary
EPA conducted an compliance evaluation inspection of Respondent's marina on July 26, 2018. The marina is discharging stormwater without a permit to the Hudson Canal. We are issuing an Administrative Compliance Order that requires the facility to develop and implement a Stormwater Pollution Prevention Plan, obtain permit coverage and eliminate the illicit powerwashing discharge. The requirements were fully explained to the facility at the time of the inspection, and the permit requirement has been in effect for multiple years while the company has been in business and its competitors have taken steps to comply. The facility also has a history of noncompliance with the NYSDEC.
