Case summary

Respondent is a permitted Phase II in New Jersey. An MS4 Audit was conducted on May 8-9, 2018. As a result of the inspection, it was determined that the Respondent was not complying with the NJDEP Highway Agency Stormwater General Permit. Violations include, but are not limited to, failure to update the Stormwater Pollution Prevention Plan, failure to ensure adequate long-term operation and maintenance for BMPs on property owned and operated by the Respondent, failure to adopt required regulatory mechanisms, failure to implement the illicit connection and MS4 outfall pipe mapping requirements, failure to implement a stormwater facility maintenance program, failure to record and track all vehicle washing activities, failure to ensure all employees are trained as required, and failure to fully implement the maintenance yard operations requirements. An Information Request and Administrative Compliance Order is being issued to order Respondent to comply with the Highway Agency Stormwater General Permit conditions.
