Under this AOC, the Respondent will: 1) construct the Fulton Wall after the design is completed under the Fulton Wall Design UAO; 2) remove MGP-related contamination at a) the Canal-side Property outside the footprint of the RH-034 Tank, following and contingent upon the City's acquisition of the Canal-side Property and demolition of structures thereon, b) at the Park Property if the RH-034 Tank is sited at the Canal-side Property, and c) if EPA selects the Park Property for the location of the RH-034 Tank, at the Park Property outside the footprint of the tank; and 3) develop plans for and provide a temporary swimming pool or pools; and, 4) if the City acquires the Canal-side Property, develop plans for and permanently replace the pool and impacted park areas of the Park Property.
