Case summary

On May 28, 2015, EPA conducted an inspection at the Respondent's facility and identified violations of the NJDEP NJPDES Vehicle Recycling (RVR) Industrial Stormwater General Permit. On July 20, 2015, EPA issued an Administrative Compliance Order to the Respondent ordering compliance with the RVR General Permit conditions. Based on subsequent submissions, Respondent has addressed the noncompliance issues in response to the Order. On November 17, 2016, EPA issued Respondent an Administrative Penalty Order with a proposed penalty of $15,000. During negotiations, Respondent presented EPA with financial and business information that were previously unavailable that demonstrated an inability to pay the proposed penalty and subsequently our penalty calculation was adjusted accordingly. This settlement includes a negotiated $2,000 penalty as memorialized in the finalized Consent Agreement and Final Order (CA/FO).
