Case summary

On June 16-18, 2015, EPA conducted a Municipal Separate Storm Sewer System (MS4) Audit of the Village. As a result of the Audit, EPA identified that the Village was not complying with the NYSDEC MS4 General Permit. Violations include but are not limited to: inadequate Stormwater Management Program (SWMP) Plan, failure to fully implement the SWMP Plan; failure to complete third party certifications, failure to map all required outfalls and conduct a complete outfall reconnaissance inventory (ORI); failure to develop, implement and enforce equivalent protection to the NYSDEC Construction General Permit, failure to implement and enforce a program that ensures adequate long-term operation and maintenance of management practices; and failure to conduct self-assessments of all municipal facilities and operations. An Information Request and Administrative Compliance Order was issued on October 21, 2015 to order the Village to address remaining noncompliance items pursuant to the NYSDEC MS4 General Permit conditions. The Consent Agreement and Final Order includes a $6,200 penalty.
