Case summary
The Project is an on-going construction activity by the Developer on a 40 acre parcel in Estate Donoe, St. Thomas and is expected to utilize 33.7 acres upon completion. The Facility is permitted to discharge pollutants associated with storm water related to the construction activities on the site. A Compliance Inspection performed by EPA at the Project in April 2016 revealed that the Operator violated provisions of an existing Administrative Compliance Order (ACO); specifically, failing to maintain BMPs, perform Site Inspections, and maintain records in accordance with the SWPPP; thus incurring violations of the Permit and the ACO. EPA issued an ACO on January 6, 2017, requiring the Respondents to bring the facility into full compliance with its Permit and the CWA.
