Case summary
In August, September and October of 2016, EPA-DESA conducted sampling of a City of Newark MS4 outfall discharging into the Second River. The sample results for the 7 dry weather samples collected verified that the discharges from this outfall were in excess of the WQS for E. Coli. This outfall has not been included in the City's MS4 program as observed during EPA's MS4 Audit conducted in 2015. Therefore, the City failed to map this outfall, conduct outfall inspections and failed to implement the Illicit Connection Elimination Program, as required the City's MS4 General Permit. This Order requires the City to implement its MS4 program at this outfall and all MS4 outfalls.
