Case summary

The Respondent operates a dry dock facility located at the Brooklyn Navy Yard in Brooklyn, New York. EPA previously issued two Administrative Compliance Orders (CWA-02-2014-3050 and CWA-02-2016-3036) and an Administrative Penalty Order (CWA-02-2016-3402) to the Respondent for MSGP violations, including failure to remove waste grit from the dry dock prior to flooding, and for unpermitted non-stormwater discharges. The Respondent applied for an individual SPDES Permit, however, continues to violate the MSGP, CWA and EPA?s Orders as only a small portion of waste grit has been removed from the dry docks. This Show Cause Order requires the Respondent to appear on August 17, 2017.
