Case summary

On September 28, 2016, EPA and NYSDEC Region 3 conducted an unannounced inspection of the Respondent's facility in Yonkers, NY. Based on findings during the CEI and review of materials submitted by Respondent on December 28, 2016, EPA identified that Respondent is in noncompliance with certain terms and conditions of the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP), including but not limited to: failure to submit a Notice of Modification (NOM) to correct the number of outfalls at the facility; failure to implement good housekeeping practices; failure to perform employee training in accordance with the MSGP; failure to include certain required Stormwater Pollution Prevention Plan (SWPPP) components; and failure to conduct and/or document Quarterly Visual Monitoring. This order requires Respondent to comply with the terms and conditions of the MSGP.
