Case summary

Respondent is the owner/operator of a 420-acre remediation and redevelopment site located off of Chevalier Avenue in Sayreville, NJ, where National Lead operated from 1934-1982. Respondent has been at the Site since the commencement of remediation activities, which began in 2008 and are expected to be completed at the end of 2017; the Site will ultimately be developed into commercial and residential properties. Respondent has coverage for stormwater discharges at the Site to the Raritan River under an individual NJDEPS permit. On February 15, 2017, EPA conducted a Compliance Evaluation Inspection (CEI) at the Site and identified that Respondent was not complying with the CWA and certain terms and conditions of its NJPDES permit, including but not limited to: discharging from an unauthorized outfall; failure to implement the Stormwater Pollution Prevention Plan; failure to implement Site-Specific Best Management Practices; and failure to conduct inspections. EPA is issuing an Administrative Order to require Respondent to comply with its permit.
