EPA v. Town of Ontario (MS4)

Case summary

On April 26-28, 2016, EPA conducted a Municipal Separate Storm Sewer System (MS4) audit of the Town of Ontario, NY MS4. As a result of the audit, EPA identified that the Town was not complying with the NYSDEC SPDES MS4 General Permit. Violations include but are not limited to: failure to update and fully implement the Stormwater Management Program Plan (SWMP Plan); failure conduct an outfall reconnaissance inventory (ORI) during dry weather; failure to implement and enforce a program that provides equivalent protection to the New York State General Permit for Stormwater Discharges from Construction Activities (CGP); failure to perform self-assessments of all municipal operations and facilities; and failure to conduct employee training. EPA is issuing an Information Request and Administrative Compliance Order to require the Town to comply with the terms and conditions of the NYSDEC MS4 General Permit.
