Case summary
The Respondent is a permitted MS4 in Peekskill, NY. EPA conducted an MS4 Audit on May 3-4, 2016 and identified that the City was not complying with the terms and conditions of the NYSDEC MS4 General Permit. Permit violations include failure to prepare an adequate SWMP Plan, failure to implement SWMP Plan, failure to conduct outfall inspections, failure to implement and enforce construction program, failure to develop and implement an adequate post-construction program, and failure to conduct self- assessments as required. On June 8, 2016, the EPA issued the City a Request for Information requiring the City to submit MS4 related information that was not available at the time of the Audit. To date, EPA has not received the requested information. An Administrative Order is being issued to order the City to comply with permit conditions.
