Respondent operates a dry dock facility located at the Foot of Broadway on the north shore of Staten Island, New York. On July 21, 2016, EPA conducted an inspection and identified that the Facility failed to comply with various conditions of its NYSDEC SPDES Individual Discharge Permit, including failure to implement the Facility's Best Management Practices Plan as required and, in addition, EPA identified unpermitted non-stormwater discharges, including hydroblast wastewater. This Order serves to require compliance with the SPDES Individual Discharge Permit and cease or obtain SPDES permit coverage for the unpermitted non-stormwater discharges. Stormwater and non-stormwater discharges from the site flow into the Kill Van Kull.
