EPA v. Town of North Hempstead (MS4)
Unilateral Administrative Order Without Adjudication
Case summary
On April 8-10, 2014, EPA conducted a Municipal Separate Storm Sewer System (MS4) Audit of the Town. As a result of the Audit, EPA identified that the Town was not complying with certain terms and conditions of the NYSDEC MS4 General Permit and issued an Information Request and Administrative Compliance Order (CWA-02-2015-3003) on November 4, 2014, which required the Town to comply with the terms of the Permit. EPA issued an amended compliance schedule on March 10, 2015. While the Town has addressed the majority of the Ordered Provisions in CWA-02-2015-3003, outstanding items remain, including but not limited to: submittal of a post-construction stormwater management practice inventory; completion of outfall mapping and an outfall reconnaissance inventory; and submittal of a complete updated/revised Stormwater Management Program (SWMP) Plan. Order CWA-02-2017-3012 requires the Town to address such outstanding items.
