Respondent is in violation of Sections 301 and 402 of the Act, 33 U.S.C. 1311 and 33 U.S.C. 1342, for failure to comply with certain requirements of the NPDES 2012 Construction General Permit specifically failure to provide maintenance to the erosion and sediment controls from November 2015 through February 2015. The construction site is approximately one acre and became eligible to obtain coverage under the NPDES CGP as it became part of a larger common plan of development. A compliance plan is required under Order to address the deficiencies found in the Compliance Evaluation inspection.
