On February 26, 2016, EPA conducted a second Compliance Evaluation Inspection of the facility located at 63 Flushing Avenue in Brooklyn, New York in response to a citizen complaint. The Respondent was identified to be in violation of the conditions and limitations of the NYSDEC SPDES MSGP including failure to implement the SWPPP (including failure to completely clean off the dry dock prior to flooding) and for unauthorized non-stormwater discharges. Stormwater and non-stormwater discharges from the site flow into the East River via outfall pipes. An Administrative Order is being issued to order the operator to comply with the MSGP.
