Respondent owns and operates the motor vehicle parts retail facility located at 36 Christian Hollow Road in Pine City, NY. Stormwater discharges from the facility drain to South Creek, a tributary of Seeley Creek and the Chemung River. Respondent has coverage under the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). EPA conducted a Compliance Evaluation Inspection (CEI) at the facility and identified violations of the MSGP, including, but not limited to the following: failure to develop and implement a SWPPP that meets the requirements in the Permit; failure to properly identify outfall(s) at the Facility; failure to adequately conduct benchmark monitoring and quarterly visual monitoring; and failure to conduct and document annual comprehensive site inspections, annual dry weather monitoring, and annual employee training in accordance with the MSGP. The Order requires Respondent to comply with the MSGP.
