Case summary

Respondent owns and operates the facility. Stormwater discharges from the facility drain via stormwater outfall pipes to the immediately adjacent Delaware River. Respondent has coverage for stormwater discharges from the Facility under the NJ Basic Industrial Stormwater General Permit, 5G2. EPA inspected the facility on May 8, 2015 and identified numerous violations of the 5G2, including, but not limited to the following: failure to eliminate exposure of source materials to stormwater, failure to develop & maintain a SPPP that meets requirements in the Permit, failure to conduct and document monthly maintenance inspections, and failure to document annual employee training. The Order requires Respondent to comply with the 5G2.
