Case summary

Region 2 executed a Memorandum of Agreement (MOA) with the Jersey City Redevelopment Agency (JCRA) to resolve an EPA CERCLA lien filed on the property comprising the City Chemical Corporation Superfund Site, located in Jersey City, New Jersey. The JCRA is not a potentially responsible party with respect to the Site. The JCRA took title to the Site in 2010 after the City of Jersey City foreclosed on its tax lien. EPA had filed its CERCLA lien prior to the filing of Jersey City's tax lien. Under the terms of the MOA, EPA will be reimbursed all of its outstanding past costs, excluding interest. Within 30 days of execution of the MOA, the JCRA will pay to the EPA $339,994, representing half of the total amount of unreimbursed costs, and EPA will discharge its CERCLA lien. Following the sale of the Site property to a redeveloper or other end user, the JCRA will pay to EPA the remaining $339,994. EPA incurred approximately $950,000 in response costs at the Site. Through a prior administrative agreement, EPA recovered approximately $300,000 from three potentially responsible parties on an ability-to-pay basis. The MOA will assist the JCRA with its goal of restoring the property to productive use and to the City's real property tax rolls.
