Case summary

The Respondent owns and operates the landfill located at 525 Rapp Road in Albany, NY. Stormwater discharges from the landfill drain to Lake Rensselaer. Respondent has coverage under the NYSDEC SPDES Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). EPA inspected the landfill as part of an Audit of the City's MS4 in June 2014. During the inspection and review of materials subsequent to the inspection, EPA identified violations of the MSGP, including, but not limited to the following: failure to conduct inspections at the required frequency; exceedances of numeric effluent limitations; and failure to remedy conditions at the facility, revise the SWPPP, and conduct additional monitoring/sampling following quarterly visual monitoring that identifies stormwater pollution, exceedances of benchmark cut-off concentrations, and exceedances of numeric effluent limitations.
