Case summary
Respondent is a medium dairy CAFO in Corfu, York with three satellite farms, in addition to the Home Farm. The Respondent is not complying with the terms and conditions of the NYSDEC CAFO General Permit. The facility was observed to be discharging contaminated stormwater from its production area to a tributary to Murder Creek which is a water of the United States. The facility was also observed to be discharging leachate from its bunk silo to a tributary to Murder Creek as the vegetated treatment area was not operated and maintained properly. The Administrative Compliance Order is being issued to require the facility to immediately cease discharging contaminated stormwater and silage leachate to Murder Creek; take the appropriate corrective actions to ensure that clean water is excluded to the fullest extent possible and properly operate and maintain the silage leachate collection system.
