Case summary

The LCP Chemicals, Inc. Superfund Site is approximately 26 acres in size and is situated in the Tremley Point section of Linden, on the Arthur Kill. From 1955 through the mid-1980s, the Site was the location of a chlor-alkali processing facility. Mercury and other hazardous substances were released throughout the Site by the processes operated by GAF and Union Carbide Corporation. One of the Respondents is a successor to GAF Corporation, and the other, a successor to Union Carbide Corporation. GAF operated a chlorine production facility at the Site from 1955 through 1972, when it ceased operations. Mercury and other hazardous substances from the chlorine production facility were released onto the soil and into lagoons surrounding the facility. Over the years, portions of the Site, including buildings, were leased to other companies, including the Union Carbide Corporation, which also released mercury onto a portion of the Site. The Administrative Order directs the Respondents to complete the Remedial Design of the remedy described in the Record of Decision for the LCP Chemicals, Inc. Superfund Site, and is issued pursuant to Section 106(a) of the Comprehensive Environmental Response, Compensation and Liability Act.
