Case summary
Respondent is a commercial solid waste incinerator unit located in Arecibo, Puerto Rico. Respondent failed to: (1) meet the emission limits for cadmium, lead and particulate matter during the 2013 performance tests, in violation of Rule 405(c)(2)(A); (2) establish representative operating limits for the initial performance tests, in violation of Rule 405(c)(2)(B); and (3) timely submit notification stating that an increment of progress was not met, as established in Table 5 of Rule 405(c). As part of the settlement, the Respondent certified that it is currently in compliance with the CAA and the Puerto Rico Regulations for the Control of Atmospheric Pollution (PRRCAP) and will install a video-graphic recorder that will continuously capture and record all thermal oxidation system operating parameters and will alert operators of any deviations. Operation of this equipment will provide more complete and timely data that will enable Respondent to more efficiently and effectively prevent and/or remedy violations. Respondent will also pay a $273,791 penalty.
