Case summary

The Defendant violated numerous provisions of the asbestos NESHAP, including failure to inspect for asbestos, failure to adequately wet the asbestos, not using leak-tight containers and proper labeling and disposal practices, and failing to provide access to EPA inspectors. The consent decree requires the Defendant to pay a civil penalty of $575,000 and implement a workplan to abate the 19 buildings involved in the illegal renovation. The Defendant must also post warning signs at the buildings prior to completing the abatement, keep the buildings sealed and conduct bi-monthly inspections to ensure that all windows and doors remain sealed to prevent release of asbestos fibers to the environment. The Defendant further agreed to conduct monthly inspections of any building that becomes occupied following abatement if asbestos-containing materials remain within the building. The Defendant must also notify the workers and visitors present during the improper 2013 renovation that they were exposed to asbestos, and offer them medical surveillance.
