Case summary

The Curtis Specialty Papers Superfund Site is the site of a former paper mill manufacturing facility that is contaminated with hazardous substances. In June 2009, the Defendants entered into an Administrative Order on Consent (AOC) with EPA to conduct a remedial investigation and feasibility study at the Site. The AOC was amended in October 2010 to include certain removal activities. EPA has also conducted response activities at the Site, including sampling and disposal of hazardous substances identified at the Site. EPA issued a Proposed Plan for the Site on May 19, 2015 and issued a Record of Decision later in September 2015. On April 10, 2017, the U.S. District Court for the District of New Jersey entered a Consent Decree regarding the Site. The Consent Decree resolves EPA's claims against three private parties that are potentially liable as current and/or past owner/operators of the Site for: (1) costs incurred and to be incurred; and (2) work to be performed in connection with the Site. Under the Consent Decree, Settling Defendants will design and implement the remedy for the Site at an estimated cost of $1,239,000. In addition, Settling Defendants will: (1) pay EPA $1,085,390.90 towards EPA's past unreimbursed costs; and (2) assign EPA their rights to recover up to an additional $1,085,390.90 in financial assurance from the former bankrupt owner. On January 23, 2018, EPA signed an agreement with the New Jersey Department of Environmental Protection (NJDEP) for EPA to receive $1,085,390.90 from NJDEP related to the remediation of the site.
