Case summary

Cost recovery sought, under CERCLA, from proposed Defendants of unreimbursed response costs incurred by EPA while conducting response activities at the NL Phase 2 Residential Properties site. EPA and Settling Defendants entered into two Consent Decrees resolving the United States' cost recovery claims. Under the Decrees, EPA will recover a total of about $4.9 million, plus interest, in past response costs which represents approximately 60 percent of its unreimbursed costs.
