Case summary
Respondent did not have Cathodic Protection on their piping system. FC was issued and facility failed to come into compliance. FC was withdrawn on January 25, 2012. Pre-filing Settlement letter was issued on March 27, 2014 and a Pre-Settlement meeting was held on May 15, 2014. Respondent removed two of the old tanks and was in the process of removing the other two. Only one tank was to be used for back-up generation and that was placed above ground. Respondent never came into compliance until December 2013. Facility is now in compliance.
