On December 31, 2013, EPA Region 2 issued an administrative complaint pursuant to Section 9006 of RCRA to the Respondent. The complaint alleges that despite several attempts by EPA to gather information from the Respondent regarding its underground storage tanks, the Respondent failed to answer questions and provide information requested by EPA. The Respondent replied to the first of two Information Request Letters (IRLs) issued pursuant to Section 9005 of RCRA, but its response was deemed deficient. EPA issued a follow-up IRL but did not receive any response to it. A penalty of $12,759 is proposed in the complaint. Amended complaint on January 21, 2015.
